abstract: Artificial intelligence poses a challenge to constitutionalism due to the difficulty of regulating it and the need to articulate it at a supranational level. The European Union has been able to pass a regulation in response to this challenge, which attempts to combine respect for fundamental rights with innovation and research. Some states and international organisations have followed suit, others, such as the United States, have taken the opposite path. However, the outcome of the AI-Act is the result of intense work by the European institutions and their various contributions, some more focused on guaranteeing rights and others on technological innovation. The Council of Europe Framework Convention gives greater weight to the ethical regulation of AI and thus generates a higher standard of protection at European level.
