abstract: The paper addresses the issue of prisoners’ rights with a particular focus on the right to health, highlighting the ongoing crisis in the prison system concerning the effectiveness of the fundamental rights that the Constitution recognizes and guarantees. Among the constitutional rights most exposed to the risk of violations—also due to the structural deficiencies of the prison system—is precisely the right to both physical and mental health. The condition of vulnerability of detainees, repeatedly emphasized by constitutional and European jurisprudence, does not seem to receive adequate attention from policymakers, who tend to favor security-oriented measures.
