Abstract: This paper critically examines the ruling of the Argentine Supreme Court of Justice in “S., I. N. c/ A., C. L.” (22 October 2024), the Court’s first decision on parentage arising from surrogacy. Drawing on the legislative history of Article 562 of the Civil and Commercial Code and the parliamentary debate that led to the removal of the specific provision, it argues that this article wasdesigned for ordinary assisted reproduction techniques and does notgovern surrogacy, which remains a legislative gap.
Against the literal interpretation adopted by the majority, the paper contends that the dissenting opinion offers the most legally consistentanswer, filling that gap through procreational will, the best interests of the child, and the surrogate’s personal autonomy. It further proposesan admissibility standard drawn from the domestic system itself, comparative law, and constitutional and human-rights principles.
