Abstract: The paper provides an overview of the evolution of digitalplatforms’ liability, from the model of broad immunity established by the 2000 E-Commerce Directive to the new framework introduced by the Digital Services Act.
Through a systematic analysis of the new regulatory tools, the aim isto highlight how the regulatory techniques introduced by the DSA – including due diligence obligations, transparency requirements, and mechanisms to counter illegal and harmful user-generated content – can ensure a higher degree of accountability for digital platforms. Alongside these measures, the paper also consider the systemic tools implemented by national authorities, aimed at ensuring effective and timely protection of the fundamental rights of individuals affected bythe circulation of harmful online content.
