Abstract

 

L’Italia, cogliendo l’occasione offerta dal PNRR, sta tentando di risolvere (o quantomeno attenuare) il problema dei tempi lunghi della giustizia attraverso una serie di interventi normativi, tra cui quello che ha previsto l’introduzione di professionalità aventi lo scopo principale di affiancare il giudice nello svolgimento delle attività giudiziarie, ovvero i c.d. addetti all’Ufficio per il Processo. Il legislatore italiano nel delineare queste nuove figure ha tentato di replicare modelli dimostratisi efficienti in altri ordinamenti giuridici, ispirandosi alle caratteristiche dei justices’ clerks e judicial assistants, propri dell’ordinamento inglese, e dei law clerks statunitensi. Nel presente lavoro vengono analizzati i punti di contatto e, soprattutto, le differenze che intercorrono tra i nuovi addetti all’UPP e gli assistenti giudiziari presenti negli USA e in Inghilterra, cercando di capire se il tentativo di ridurre i tempi del giudizio e di riportare il processo italiano a un modello di efficienza e competitività attraverso l’introduzione di queste nuove professionalità si prospetta fruttuoso o meno.

Italy, seizing the opportunity offered by the PNRR, is attempting to solve (or at least mitigate) the problem of long judicial times through a series interventions, including one that has provided for the introduction of professional figures whose main purpose is to assist the judge in carrying out judicial activities, i.e. the so-called “addetti all’Ufficio per il Processo”. In outlining these new figures, the Italian legislator attempted to replicate models that have proved efficient in other legal systems, drawing inspiration from the characteristics of the justices’ clerks and judicial assistants, typical of the English legal system, and the US law clerks. In this paper we analyse the points of contact and, above all, the differences between the new “addetti all’Ufficio per il Processo” and the ‘judicial assistants’ in the USA and in England, trying to understand whether the attempt to reduce the time of the judgement and to bring the Italian trial back to a model of efficiency and competitiveness through the introduction of these new professional figures will be fruitful or not.
